Just because you’ve been banned from driving doesn’t mean that you can’t get back on the road much sooner than you might imagine.


It is possible to remove your driving disqualification before the end of the disqualification period in some situations. The court will want to see evidence that you are not a risk to other people on the road and can safely be trusted do drive again.


You will only be able to make an application if your disqualification was for more than two years and you have served the minimum period of your disqualification. Minimum periods are set out in the table.

I got a 3 year ban for a second offence, can I apply?


Yes. The law allows anybody to apply to remove the driving disqualification who has been banned from driving for more than two years regardless of the reason for the ban being imposed.


When the court makes its decision, they will take into account the fact that you have more than one previous conviction for drink driving and this will make the judge more concerned that you will commit further offences. An experienced solicitor will be able to deal with these problems for you and help you put together evidence to allay the judge’s concerns

What do I need to do?


First, you will need a solicitor to have a realistic prospect of getting your licence back early. Your solicitor will apply to the court that disqualified you for a hearing to remove your disqualification.


Before the hearing, you will need to work with your solicitor to put together a package of evidence to convince the court that they should remove your driving disqualification. Good examples of such evidence includes things that show something in your life has changed significantly – maybe you’ve had kids, got married or started a business. These are things that will make a court think you are less likely to commit another drink driving offence and so the court will be more likely to give you your driving licence back.


It's also important to be able to give the court a clear explanation why you need your licence back. These are things your solicitor will discuss with you as part of the case preparation.

How likely am I to succeed?


The answer to that depends heavily on why you lost your licence and what you can show to the court to prove that you are no longer a risk to other members of the public.


There is no substitute for good legal advice and thorough preparation of applications to end a driving disqualification early. If you do not prepare, show the court evidence that you are no longer a risk to others on the road, and give a good explanation why you need your licence back then you will not succeed.
